About the Board of Adjustment

The Board of Adjustment is a City of Tuttle quasi-judicial board created, in accordance with 11 OS 43-101 et seq., with the following power to hear and decide:

  • The granting of variances to the Tuttle Zoning Code.
  • The granting of Special and Minor Exceptions to the Tuttle Zoning Code as specified and permitted in the Tuttle Zoning Code.
  • Appeals where it is alleged that there is an error of law in any requirement, decision, or determination made by the Community Development Department in the enforcement of the Tuttle Zoning Code.
  • Appeals where it is alleged that there is an error of law in any requirement, decision, or determination made by the Community Development Department in the enforcement of the International Building Code, the Residential Building Code, the International Mechanical Code, the International Plumbing Code, the National Electrical Code, the International Existing Building Code, the International Fuel Gas Code, the International Property Maintenance Code, and the International Swimming Pool and Spa Code.
  • Appeals where it is alleged that there is an error of law in any requirement, decision, or determination made by the Community Development Department or the Fire Department in the enforcement of the International Fire Code.
  • Appeals where it is alleged that there is an error of law in any requirement, decision, or determination made by the Community Development Department regarding the issuance of a building permit (or lack of) by the Community Development Department.
  • Design Reviews of Exceptions from the Building and Site Design Standards in Section 30D of the Tuttle Zoning Code.
  • Select oil & gas appeals.
  • The granting of floodplain variances.

After a request has been fully presented, the Board of Adjustment will vote to approve, approve conditionally, or deny the request.  A concurring vote of three members is required to approve, defer or deny an item. If the request is approved, the applicant can use the property in accordance with the Board's approved action. If denied, appeals of the decision of the Board may be filed with the District Court of Grady County (any person may appeal any decision of the Board to District Court).  Matters decided by the Board of Adjustment are not appealable to the Tuttle Planning Commission or the Tuttle City Council.

The Board of Adjustment meets on the first Thursday of every month. The meeting calendar and submission deadlines can be found at the link below.  The meetings normally will be at Tuttle City Hall, 221 W. Main St.

Agendas are available prior to the meetings. Minutes are available following approval.
